Case Study: Unblocking Value Added Tax (VAT) Invoices in Ukraine

VAT invoice unblocking in Ukraine may require both documentary explanations to the tax authority and a court appeal when registration is refused without a sufficiently reasoned basis. Source material describes a case involving eight Value Added Tax (VAT) invoices issued after a Ukrainian company supplied goods to a counterparty.

Why the invoices were blocked

The tax authority suspended registration of all eight invoices using the same reason: a mismatch between supply and purchase volumes for goods classified under Ukrainian Classification of Foreign Economic Activity commodity code (UKT ZED) 9403. The taxpayer was invited to submit primary financial and accounting documents together with written explanations of the transactions.

Documentary response

After reviewing the transaction, the tax lawyer prepared written explanations and analysed the primary documents submitted to the tax service. The purpose was to demonstrate the commercial substance of the supplies and provide the records requested by the authority.

Refusal and court challenge

The authority nevertheless refused registration. Review of comparable court practice identified grounds for challenging the decision, and an administrative claim seeking cancellation of the refusal was filed with the District Administrative Court of Kyiv.

The tax authority argued that the taxpayer had not submitted all necessary documents and that some materials were allegedly prepared in breach of legal requirements. Case, the authority did not identify which documents were defective, which specific legal requirements had been breached or which additional documents were missing.

Court outcome

The court accepted the taxpayer's position and concluded that the tax authority had not proved the legality and justification of the challenged decisions. The relevant commission decisions refusing registration were therefore treated as unlawful and subject to cancellation in the source case.

VAT invoice appeal strategy should connect every submitted document to the stated reason for suspension and record any failure by the authority to explain its refusal. A clear documentary trail strengthens both the administrative response and any later court challenge.
