Pre-Trial Claims Against Commercial Counterparties

Pre-trial commercial claim is a written demand asking a counterparty to perform a contractual obligation, compensate losses or pay an amount due before court proceedings begin. It can create a clear record of default and give the debtor a final opportunity to resolve the dispute voluntarily.

Pre-trial settlement under Ukrainian commercial law is generally a right rather than an automatic obligation in every dispute. Even where it is not mandatory, a properly drafted claim can clarify positions and support later litigation.

What a Claim Should Contain

A commercial claim should identify the claimant and debtor, include the date and reference number, state the contractual and factual basis of the demand and explain the evidence supporting it.

The requested remedy should be specific. For a monetary claim, the document should state the amount, calculation and payment details. Copies of contracts, invoices, acceptance documents, correspondence or other evidence should be attached where relevant.

How to Send the Claim

Keeping a complete copy is important. The signed claim can be sent by registered or insured mail with a description of enclosures or delivered against acknowledgement so that the creditor can prove both content and delivery.

Pre-trial correspondence can also test whether the dispute is capable of settlement and identify the debtor's likely defence before a court claim is prepared.

The claim should also contain the claimant's payment details where money is demanded and a list of all documents supporting the request. Evidence should be attached as originals or properly certified copies where appropriate. Preparing two complete copies and retaining proof of dispatch creates a record that can later be used in court.

Pre-trial settlement can also preserve a commercial relationship by giving the counterparty one documented opportunity to correct the breach before litigation. The demand should not be overloaded with general legal language: it should explain what happened, what must be done, the amount claimed where relevant and the deadline for voluntary compliance.

Pre-trial claim strategy should turn the creditor's contractual position into a precise written demand with evidence, calculation and proof of delivery, while preserving the option to proceed to court if payment is not made.
