Recovery of Payment Under a Supply Contract

Supply contract debt recovery is used when goods have been delivered but the buyer fails to pay within the contractual period. Recovery depends on proving the supply obligation, delivery, the agreed price and the date when payment became due.

Documents Supporting the Claim

The supply agreement is the starting point because it defines the goods, price, payment terms and liability for breach. Delivery notes, acceptance documents, invoices, payment records and correspondence can confirm that the seller performed its part and that the buyer's payment obligation became due.

Where only part of the price has been paid, the claim should distinguish amounts received from the outstanding balance. Contractual penalties, interest or other consequences of late payment should be calculated separately and linked to the relevant contractual provisions.

Pre-Trial and Court Recovery

A written demand can request payment and provide the buyer with a final period for voluntary settlement. If payment is not made, the creditor may proceed with a commercial court claim and submit the documents proving delivery and the amount outstanding.

Disputes often arise over quality, quantity, delivery dates or acceptance of goods. These issues should be identified before filing because the buyer may use them to challenge the debt or reduce the claimed amount.

Supply disputes can also involve partial deliveries, returns, acceptance objections or disagreement over whether payment was conditional on additional documents. These points should be mapped against each shipment and invoice so that the claim does not treat a multi-stage supply relationship as one undifferentiated balance.

Payment recovery under a supply agreement is stronger when the seller can connect each amount claimed to the contract, delivery evidence, payment schedule and documented communication with the buyer.
