Corporate, Commercial Law and Dispute Resolution · Contracts, Commercial Law and Transactions
Ukrainian Chamber of Commerce and Industry (UCCI) expert opinions can support commercial, arbitration, customs and tax disputes by documenting market values, economic conditions, contract performance and other facts relevant to a case. Their practical value depends on whether the opinion addresses an issue that the court, arbitral tribunal or authority must decide.
When a UCCI Expert Opinion May Be Relevant
Expert opinions may be used in disputes between companies, customs disputes, tax disputes, arbitration, litigation concerning contract performance, market-value questions, economic circumstances and analysis of foreign-trade activity.
Obtaining an Expert Opinion
Work can include analysis of the dispute, preparation of the application to UCCI, organisation of supporting evidence, review of documents, communication with experts and preparation of the client's legal position.
The process should connect the expert question with the legal issue in dispute. A technically correct opinion may have limited value if it does not address a fact that matters to the claim or defence.
Use in Commercial and Arbitration Proceedings
UCCI materials may support market-value evidence, economic indicators, foreign-trade circumstances, material changes in circumstances, calculation of losses and analysis of contract performance.
In international arbitration, the opinion may be included with the broader evidential record and considered together with contracts, invoices, correspondence and other expert materials.
Customs Disputes
Expert material can be relevant to disputes over customs value, foreign-trade contracts and customs clearance. Legal support may include challenging customs decisions, preparing evidence and using the UCCI opinion in court.
Tax Disputes
In tax matters, an opinion may be used to support market prices, economic substance of transactions, commercial justification and responses to claims by tax authorities.
UCCI expert evidence strategy should define the evidential question before the opinion is commissioned and then integrate the resulting document into the wider legal position for the court, tribunal or authority.
